Under Enrollment Forms
As you are aware of, immigration regulations require that students be enrolled full-time at all times, unless: a) they have a medical condition or b) it is their last quarter before graduation and do not have many classes to complete. We have learned of several students who are completing their programs this winter quarter and are registered for less than full-time and are yet to process their under enrollment paperwork (REMEMBER, this is required to maintain your legal status). If you are one of these students, please fill out the under enrollment form ASAP and turn it in to our office NO LATER than this coming Monday, January 22.
USCIS Memo on H Eligibility Questions
For all those students who are currently in OPT or are planning on getting a work visa, this memo from USCIS will be useful in answering some of your questions regarding the H1-B process.
This USCIS memorandum from Michael Aytes provides guidance on how USCIS adjudicators should determine periods of admissions for an H-1B or L-1 alien. The memo:
- Clarifies that time spent as an H-4 and L-2 dependent does not count against the maximum allowable periods of stay available to principals in H-1B and L-1 status.
- Clarifies that H-1B aliens, who qualify under American Competitiveness in the Twenty-First Century Act of 2000 (AC21) (Pub.L.106-313) section 106(a) and (c), need not be in H-1B status when requesting an additional period of stay beyond the six-year maximum.
- Clarifies how to determine the maximum period of admission in H-1B status for a beneficiary who was in the United States in valid H-1B status for less than the six-year maximum period of admission, but who has since been outside the United States for more than one year. Read more...
